Protection and disclosure of information

The TDA, in line with the requirements of the Freedom of Information Act 2000 (FOI), works on a presumption of openness but may need to withhold certain information where an exemption applies or the public interest is not served by releasing the information.

In particular, this provision relates to information where disclosure could lead to improper gain or advantage, or would prejudice negotiations, or the conduct of personnel, management, or commercial or contractual activities.  These exemptions to disclosure include:

personnel records;

  • anything that affects the privacy of an individual
  • a third party's commercial confidences, and
  • information given in confidence.
